CHAPTER IX

PENALTIES

Article 38: Any political party which violatesArticle 31 of this law shall be subject to a fine of three million (3,000,000)riels in cash.

Any political party found guilty of repeatedoffences under this article shall be fined double this amount, in

addition to which it may be ordered to ceasetemporarily all activities.

Article 39: Any political party which violatesArticles 7 or 29 of this law shall be subject to a fine of between

three million (3,000,000) and five million(5,000,000) riels in cash.

Any political party found guilty of repeatedoffences under this article shall be fined double this amount, in

addition to which it may be ordered to ceasetemporarily all activities.

Article 40: Any person who violates Article 5 orthe second paragraph of Article 15 of this law shall be

subject to a fine of one million (1,000,000) rielsin cash.

Article 41: Any person who:

1. continues to administer a political party whoseregistration has been refused by the Ministry of Interior;

2. continues to administer a political party whichhas been declared dissolved by irrevocable decision of a

competentcourt;

3. administers a political party which has notapplied for registration within eighteen (18) month of the

election of the provisional committee referred toin Article 9 of this law; or

4. maintains a party office open after the party'sdissolution or temporary cessation of activities has declared

by irrevocable decision of a competent court;

shall be subject to a fine of between one million(1.000,000) and five million (5,000,000) riels in cash, and/or to

between one month's and one year's imprisonment.

Article 42: Amy person who violates Article 6 ofthis law shall be punished in accordance with the applicable

criminallaw.

P 10,'In line with Art 39 of the Law on the Statues of Civil Servants, civilservants acting in favour or against any political party or candidate aresubject to administrative penalties. There are some reasons to believe thatthese provisions may not always have been applied. Managers who do not makepublic facilities available to political parties and candidates or do notrespond to an application to do so is to receive a warning.
