Questionsas to elected members to be determined by High Court
82 (1) All questions which may arise from any election as to theright of any person to be or remain an elected member of the NationalParliament shall be referred to and determined by the Court on a petitionpresented by the Attorney-General or byan
elector, in accordance with the procedure prescribed by Rules made undersection 85 for the presentation and hearing of an election petition and thedecision of the Court on any such petition shall be final and shall not bequestioned in any other proceedings.
Presentationof election petition
83(1) A petition complaining of an undue return or undue electionof a member of
the National Parliament hereinafter called an election petition,may within one month
from the date of the publication, in pursuance of section57(2)(b), of the result of the
election in relation to an electoral constituency be presented tothe Court in its civil
jurisdiction by any one or more of the following persons, that isto say—
(a) some person who voted or had a right to vote at that electionfor the electoral
constituency to which the petition relates; or
(b) some person who claims to have had a right to be returned orelected at such
election; or
(c) some person who alleges himself to have been a candidate atsuch election.
