IV. LJUDSKA INICIATIVA

Art. 57

(1) Najmanj trideset tisočvolivcev lahko da predlog za začetek postopka za spremembo ustave.

(2) V predlogu mora biti navedeno, v čem in kako naj seustava spremeni, ter razlogi za spremembo. Predlogu morajo biti priloženipodpisi najmanj trideset tisoč volivcev.

Art. 58

(1) Najmanj pet tisoč volivcev lahko predložidržavnemu zboru predlog zakona.

(2) Predlog zakona mora vsebovati sestavine, ki jihdoloča poslovnik državnega zbora. Predlogu morajo biti priloženi podpisinajmanj pet tisoč volivcev.

2. Legislative procedure

a) General provisions

Art. 115

(1) Adraft law contains the title of the law, an introduction, the text of thearticles, and a statement of reasons.

(2) The introduction includes:

-         an evaluation of the state of affairs andreasons for adopting the law,

-         the goals, principles, and main solutions ofthe draft law,

-         an estimation of the financial implications ofthe draft law regarding the state budget and other public finance resources,

-         a statement that the resources for theimplementation of the law are provided in the state budget if the draft lawenvisages the use of budgetary resources in a period for which the state budgethas already been adopted,

-         a presentation of the regulation of suchmatter in other legal systems and of the harmonisation of theproposed regulation with the law of the European Union; such presentation mustinclude a presentation of the regulation of such matter in the legal systems ofat least three European Union Member States,

-         other consequences the adoption of the law mighthave.

(3) Ifa draft law does not contain the required information referred to in thisarticle, the President of the National Assembly calls upon the proposer tosupplement the draft law. If the proposer fails to supplement the draftlaw within 15 days from being called upon to do so by the President of theNational Assembly, it is deemed that the draft law has not been tabled.

(4) In the text of articles, feminine and masculineforms should be used in those first articles or chapters of the draft law whichdefine the primary subjects of the draft law, together with an explanation thatthereinafter the masculine form would be used.

(5) The provision of the preceding paragraph does notapply where amendments to a law are proposed.

(6) Where amendments to a law are proposed, theproposer encloses with the draft law the text of those provisions of the law towhich amendments are proposed.

(7) The statement of reasons explains the contents andpurpose of individual articles of the draft law and the consequences andinterrelations of the solutions contained therein.

6. Procedure for amending the Constitution

Art. 173

(1) A proposal to initiate the procedure for amendingthe Constitution may be submitted to the President of the National Assembly by20 deputies, the Government, or at least 30,000 voters. Each proposerdetermines their representative.

(3) Theproposal must state how the Constitution should be amended and the reasonstherefor. The proposal to initiate the procedure for amending the Constitutionmust include the first draft of the constitutional act.

(4) A representative of thevoters submits the proposal referred to in the preceding paragraph no laterthan 30 days after the expiry of the period determined for the gathering ofvoters’ signatures in support of the proposal to initiate the procedure foramending the Constitution.

(5) Ifthe proposal does not contain the required contents referred to in Article 172and in paragraph three of this article, the President of the National Assemblycalls on the proposer to supplement the proposal. If the proposer doesnot supplement the proposal within 15 days at the latest after being called onto do so by the President of the National Assembly, it is deemed that theproposal to initiate the procedure for amending the Constitution has not beensubmitted.
