58Hearing of election petition
(3) At the conclusion of the hearing, the Court shall determinewhether the member whose return or election is complained of or any other andwhat person, was duly returned or elected or whether the election was void and,shall certify such determination to the Minister; and, upon such certificatebeing given, such determination shall befinal and shall not be questioned in any proceedings and the election shallbe confirmed, or a new election shall be held, as the case may require, inaccordance with such certificate:
Provided that where the High Court finds that any candidate whohas been declared to be elected was not qualified or was disqualified at thetime of his election, the High Court shall determine the election to be void.
