PART VIII -DETERMINATION OF ELECTION PETITIONS ARISING FROM ELECTIONS

137.

(1) An electionpetition may be presented by one or more of the following

persons—

(a) a candidate inan election;

(b) a politicalparty which participated in the election.

(2) A person whoseelection is complained of is, in this Bill, referred to as the

respondent.

(3) If thepetitioner complains of the conduct of an Electoral Officer, a Presiding

or ReturningOfficer, it shall not be necessary to join such officers or persons

notwithstandingthe nature of the complaint and the Commission shall, in this

instance, be—

(a) made arespondent; and

(b) deemed to bedefending the petition for itself and on behalf its officers or such otherpersons.
