Article 98. 1. The subject of the complaint,having established that the decisions, actions or inactions of the subject of appeal do not correspond to thelegislation on elections of the President of Ukraine, cancels the decision inwhole or in part, recognizes the actions or inaction illegal, obliges subjectof the complaint to satisfy the demands of the applicant or restore theviolated electoral rights of the citizen, rights and lawful interests of thesubject of the electoral process through other means, or obliges the subject ofthe court appeal or other authority, political party (bloc of parties), massmedia or public official to undertake actions, prescribed by the legislationregulating the organization and order of conduct of the election of the Presidentof Ukraine, which follow from cancelling the decision, declaring appealedactions and inaction illegal

2. In case of cancellation by the court ofdecision of the election commission, including declaring the voting results atthe polling stations and tabulation of voting results invalid, the decision onthis issue shall be taken by the Electoral Commission, whose decision wasreversed or higher election commission by a court decision. This electioncommission cannot make a judgment which essentially repeats the decisionoverturned by the court.

3. Higher election commission on the basisof the complaint, and court decision may reverse the decision of the lowerlevel election commission and decide on the merits or oblige lower levelelection commission to re-examine the issue raised.

4. The subject of the appeal rejects theappeal if it establishes that the appealed decisions, action or inaction havebeen made in accordance with the legislation and within the powers provided bylaw.
