? 82. (1) The Constitutional Court shall have jurisdiction to hear anddetermine whether- (a)a person has been validly elected as a member of theNational Assembly; or (b) the seat of a member of a National Assembly hasbecome vacant.
? (2) Anapplication under clause (1) (a) may, in the case of – (a) a directly electedmember, be made by any person entitled to vote at an election in the electoralarea for which the member was returned, any person who was returned, any personwho was a candidate at the election in the electoral area or the Attorney-General;or (b) a proportionately elected member, be made by any member or theAttorney-General. (3) An application under clause (1) (b) may, in the case of-(a)a directly elected member, be made by any
member, any person entitled to vote at an election in the electoral area forwhich the member was returned or the Attorney General; (b)a proportionatelyelected member, be made by any member, or the political party of which theproportionately elected member was a member at the time of election and which nominatedthe
person as a member or the Attorney-General.
