Article 44 (5) A petitioner in an election petition mayclaim (a) a declaration that the election is void; or(b) a declarationthat the nomination of a proportionately elected member of the NationalAssembly is void(c) a recount of the ballot papers.
Article 46.(1) At the conclusion of the trialof an election petition the counts as to Constitutional Court shalldetermine validity of election (a) whether the election was valid;(b)whether the election was void; or(c) whether a recount of the ballot papers isrequired or not;(d) whether the nomination of a proportionately elected memberof the National Assembly was valid;(e) whether the nomination of aproportionately elected member of the National Assembly was void, and shallcertify the determination to the Electoral Commissioner.
