National referenda

Article 8

1. Parliament shall order a national referendumupon the motion of at least two hundred thousand electors. Parliament may ordera national referendum upon the motion of the President of the Republic, theGovernment or one hundred thousand electors. The decision made by any valid andconclusive referendum shall be binding on Parliament.

2. National referenda may be held about anymatter within Parliament’s responsibilities and competences.

3. No national referendum may be held on:

a. any matter aimed at the amendment of theFundamental Law,

b. the contents of the Acts on the StateBudget and its implementation, the central tax type, pension or healthcarecontributions, customs and the central conditions for local taxes,

c. the contents of the Acts on the electionsof Members of Parliament, local representatives and mayors, and members of theEuropean Parliament,

d. any obligation arising from aninternational agreement,

e. any matter related to human resources andthe establishment of organisations within the competence of Parliament,

f. the voluntary dissolution of Parliament,

g. the mandatory dissolution of anyrepresentative body,

h. the declaration of a state of war, state ofnational crisis and state of emergency, and on the declaration or extension ofa state of preventive defence,

i. any matter related to participation inmilitary operations,

j. the granting of pardons.
