Article 329

Special Regions of Development(RED)

The State will establishSpecial Regions of Development, these being entities created with the proposition of acceleratingthe adoption of technologies that permit the production and provision ofservices with a high aggregate value, in a stable environment, with transparentrules[,] able to capture the national and foreign investment that is requiredfor accelerated growth, to create the jobs that are necessary to reduce socialinequalities, to grant to the population the services of education, health,public security and the infrastructure necessary that permits a real bettermentin the condition of life of the region.

The systems that areinstituted in the Special Regions of Development must be established by a Constitutional Statute adoptedby the National Congress with a qualified majority of the two-thirds part ofthe totality of its members. Once promulgated[,] this Constitutional Statutemay only be modified, reformed, interpreted or abrogated with the same majorityindicated above, [with] prior referendum of the citizens that inhabit theSpecial Region of Development that is concerned.

Article 15.5

(Seg?n reformapor Decreto 127-2000) La creaci?n o fusi?n de municipios corresponde alCongreso Nacional. Para la creaci?n y fusi?n de un municipio es necesariocumplir los requisitos siguientes:

5) Plebiscitofavorable para la creaci?n del municipio con un resultado en que hayaparticipaci?n como m?nimo el diez por ciento (10%), de los ciudadanos del areageogr?fica, que lo conformar?, el cual ser?

convocado por laSecretar?a de Estado en los Despachos de Gobernaci?n y Justicia, cuando as? losoliciten por escrito por lo menos mil ciudadanos residentes en el area que sepropone desmembrar, cuyo plebiscito ser? supervisado por el Tribunal Nacionalde Elecciones (T.N.E.).
