Article 85. 1. If any violations of this Federal Law,the Federal Law 'On Basic Guarantees of Electoral Rights and the Right ofCitizens of the Russian Federation to Participate in a Referendum' werecommitted in the conduct of voting or establishment of voting results, asuperior election commission, before it establishes the voting results and theresults of the election of the President of the Russian Federation, may reverse the decision of asubordinate election commission on the voting results and order a vote recountor, if the violations do not make it possible reliably to establish the resultsof the expression of the voters' will, it may annul the voting results.

Article 328. When examining appeals, appellate reports, the court ofappellate jurisdiction is authorized:

To leave invariable judgment made by the first instance court, todisregard the appeal, the appellate report;

To change the judgment made by the first instance or cancel itmaking a new judgement;

To repeal in full or inpart the judgment made by the first instance and to discontinue the proceedingsor dismiss the application.

EMB: reverse the decision of a subordinate electioncommission on the voting results and order a vote recount, annul the votingresults.

Court:leave the elections results unchanged;
