Legal provisions for direct democracy at the local level

LawNo. 22/2004 Coll. on Local Referendums

Mandatoryreferendum on separation of municipalities (validity requirement – “yes” voteby 50% of electorate);

Optionalreferendum can be initiated by Municipal Council; at least 35% of registered voters must participate inthe referendum in order for the result to be valid and the result of the local referendum isbinding if the majority of legitimate persons participating in the referendumvoted for the result, and at least 25% of persons entitled to vote voted forthe result.

Citizens’initiative requires the support of 30% of residents in municipalities of up to30 000 residents sliding to 6% in municipalities of more than 200 000residents.
