Section 40:
“(1) The High Court shallhave jurisdiction to hear and determine any question whether:
(a) any person has been validly elected as a Representative or Senator;”
(2) An application to the High Court for the determinationof any question under subsection (1)(a) of this section may be made by any person entitled to vote in the electionto which the application relates or by any person who was a candidate at thatelection or by the Attorney General and, if it is made by a person otherthan the Attorney-General, the Attorney-General may intervene and may thenappear or be represented in the proceedings.”

HOUSE OF ASSEMBLY (ELECTIONS) ACT 14 of 1951, CHAPTER
Section 65:
“A petition complaining of an undue return orundue election of a member of the House of Assembly, in this Act called anelection petition, may be presented to the High Court by any one or more of thefollowing persons:
1. someperson who voted or had a right to vote at the election to which thepetition relates;
2. some person claiming to have had a right tobe returned at the election;
3. some person alleging himself to have been a candidate at the election.”
