Article9. Financing of elections

Allocation of means ascharity to the electoral fund of a candidate and a political party isprohibited by the following legal entities and physical persons:

- Foreign countries andforeign legal entities.

- Foreign citizens andstateless persons.

- Citizens of theRepublic of Tajikistan that haven’t reached age of 18.

- Legal entities that areestablished with participation of foreign investments.

- Internationalorganizations and international public movements.

- Local bodies of stategovernment and local self-governments.

- State organizations andorganizations, where the share of state exceeds more than 30 percent.

- Military units andother military subdivisions and other military structures and law enforcementbodies.

- Religious and charity organizationsand organizations established by these.

- Fees from unknownpersons.

Incases of contribution to the electoral funds of candidates and politicalparties by legal entities and physical persons, who have no right to do so, orcharity means of physical persons and legal entities that surpass the providedin the present article amount of contribution, the fund is completelytransferred to the republican budget.

The Central Commissionfor Elections and Referendum of the Republic of Tajikistan determines the formof financial reports of electoral commissions on income and expenditure ofmeans, and financial reports of candidate to deputies and political parties on wiretransfer to their electoral fund and its expenditure.

Candidate to deputies andpolitical parties return remaining means allocated from the budget to therelevant electoral commission not later than 30 days after the elections.Remaining means of electoral funds of candidate to deputies and political partyestablished from the personal means of candidate, political parties, physicalpersons and legal entities are returned to them proportionally.

The Central Commissionfor elections and Referendum of the Republic of Tajikistan implements controlover proper utilization of means allocated to relevant electoral commissionsfor administering elections, sources of correct recording and purposefulutilization of electoral funds by candidate to deputies and political parties.

Candidate to deputies andpolitical party cannot use other means for conduction of elections except themeans of electoral fund of candidate to deputies and political party. If acandidate to deputies or political party uses other sources but the means ofthe electoral funds of candidate and political party, the relevant electoral commissioncan cancel decision on registration of candidate to deputies and submitted listof candidates of political party.

Using state property and means notprescribed by law is prohibited.
