ELECTORAL CODE OF THE REPUBLIC OF BELARUS (with amendments in 2011)
Article 1. Relations Regulated by this Code
This Code regulates relations arising during preparation and holding of elections of the President of the Republic of Belarus, electionsand recall of deputies of the Chamber of Representatives of the NationalAssembly of the Republic of Belarus (hereinafter the Chamber ofRepresentatives), members of the Council of the Republic of the NationalAssembly of the Republic of Belarus (hereinafter the Council of the Republic) and deputies of local Councils of Deputies of the Republic of Belarus (hereinafter the local Councils of Deputies) as well as during preparation and holding of thereferendum (people’s vote) (hereinafter the referendum) and establishes guarantees securing free expression of will by citizens of the Republic of Belarus.
Article 129. Grounds for Recalling a Deputy
A deputy of the Chamber ofRepresentatives or a deputy of a local Council of Deputies of the Republic ofBelarus, who has not justified the trustof the voters, that has manifested itself in failure to execute the Deputy'sduties as stipulated by law, in breaching the Constitution of the Republic of Belarus and of the laws of the Republic of Belarus and of acts of the President of the Republic of Belarus, in committing actions discrediting the deputy, may be recalled by the electors according to the procedureestablished by the present Code.
Article 143. Grounds for andProcedure of Recall of the Member of the Council of the Republic
Any member of the Council of theRepublic, who has failed in the trustextended to him by neglecting the duties of the member of the Council of the Republic, violating the Constitution of the Republic of Belarus laws of the Republic of Belarus or acts of the President of the Republic of Belarus, orcommitting actions discrediting the member of the Council of the Republic maybe recalled.
Recall of the member of the Council of the Republic appointed by the President of the Republic of Belarus shall be established by the President of the Republic of Belarus
The procedure of recall of themember of the Council of the Republic appointed by the President of theRepublic of Belarus shall be established by the President of the Republic ofBelarus.
Constitution of the Republic ofBelarus
Article 72 The recall of deputiesshall be exercised to the order and instances as determined by the law.
The voting for the recall of adeputy shall be exercised to the order determined for the election of thedeputy, and on the initiative of no less than 20 percent of the citizenseligible to vote and resident in the corresponding area.
The reason and order for the recallof a member of the Council of the Republic shall be determined by the law.
