(Mandatory and Optional Referendum, Citizen Initiative and Recall)

Article 17.

The people shall have the right of election, recall, initiativeand referendum

 

Article 123.

The people of the hsien shall, in accordance with law, exercisethe rights of  initiative and referendumin matters within the sphere of hsien self-government, and shall, in accordancewith law, exercise the rights of election and recall of the magistrate andother hsien self-government officials

 

(Mandatory Referendum)

Article 27(4).

To vote on proposed Constitutional amendments submitted byLegislative Yuan by way of referendum.

 

Article 174.

Amendments to the Constitution shall be made in accordance withone of the following procedures:

(1) Upon the proposal of one-fourth of the Members of theLegislative Yuan and by a resolution of three-fourths of the Members present ata meeting having a quorum of three-fourths of the Members of the Yuan, anamendment may be drawn up and submitted to the National Assembly by way ofreferendum. Such a proposed amendment to the Constitution shall be publiclypublished half a year before the National Assembly convenes

(Mandatory Referendum)

Article 1.

The electors of the free area of theRepublic of China shall cast ballots at a referendum within three months of theexpiration of a six-month period following the public announcement of aproposal passed by the Legislative Yuan on the amendment of the Constitution oralteration of the national territory. The provisions of Article 4 and Article174 of the Constitution shall not apply.

For thenational referendum, this Act shall apply to the following matters:

1. Referendumof laws.

2. Initiativeof legislative principles.

3. Initiativeor referendum of important policies.

4. Referendumfor amendment of the Constitution.
