Article33 (4) and (5).

(4)The function of the Commission shall be to supervise the Supervisor ofElections in the performance of his functions under sections 34(1), 38(9) and113(5).

 

(5)The Commission may regulate its own procedure and, with the consent of thePrime Minister, may confer powers and impose duties on any public officer or onany authority of the Government for the purpose of the discharge of itsfunctions.

 

Article38 (9).

Theconduct of any referendum for the purposes of this section shall be theresponsibility of the Supervisor of Elections and the provisions of subsections(4), (5) and (7) of section 34 shall apply in relation to the exercise by theSupervisor of Elections or by any other officer of his functions with respectto a referendum as they apply in relation to the exercise of his functions withrespect to elections of Representatives.

 

Article113 (5).

Comment

TheSupervisor of Elections, under the supervision of the Electoral Commission, isresponsible for managing the administration of direct democracy. The appointedsupervisor is governmental.
