Article 196 (1)
Subject to this section, Parliament may amend this Chapter and thesections of this Constitution listed in the Schedule only if
a. the provision to be amendedand the proposed amendment to it have been put to a referendum of the people ofMalawi and the majority of those voting have voted for the amendment; and
b. the Electoral Commissionhas so certified to the Speaker.
Article 196(1)(b) of the Constitution states that the amendments to the constitution may be made only after ‘the electoral commission has so certified to the speaker’. It is thus assumed that the electoral commission is responsible for managing the administration of direct democracy mechanisms at the national level.
