Section 38.

7) The conduct of any referendum for thepurposes of this section shall be the responsibility of the Supervisor ofElections and the provisions of subsections (4), (5) and (6) of section 34 ofthis Constitution shall apply in relation to the exercise by the Supervisor ofElections or by any other officer of his functions with respect to a referendumas they apply in relation to the exercise of his functions with respect toelections of Representatives.

Section 34:

 (1) There shall be a Supervisor of Electionswhose duty it shall be to exercise general supervision over the registration ofvoters in elections of Representatives and over the conduct of such elections.

(2)The functions of the office of Supervisor of Elections shall be exercisedeither by the person holding or acting in such public office as may for the timebeing be designated in that behalf by the Public Service Commission or, if theCommission so decides, by such other person who is not a public officer as mayfor the time being be so designated, but before exercising its powers underthis subsection the Commission shall consult with the Prime Minister.

(6)In the exercise of his functions under the foregoing provisions of thissection, the Supervisor of Elections shall not be subject to the direction orcontrol of any other person or authority.

Comment

The Supervisor of Elections is a governmental body responsible formanaging the administration of referendums.
