Issues excluded from being the subject of an initiative at the national level

ARTICLE 170

[…] There can be no referendum with respect to laws approving international treaties or the budget or laws relating to fiscal or tax matters.

ARTÍCULO 29. MATERIAS QUE PUEDEN SER OBJETO DE INICIATIVA POPULAR LEGISLATIVA Y NORMATIVA ANTE LAS CORPORACIONES PÚBLICAS. Sólo pueden ser materia de iniciativa popular legislativa y normativa ante las corporaciones públicas, aquellas que sean de la competencia de la respectiva corporación.

No se podrán presentar iniciativas populares legislativas y normativas ante el Congreso, las asambleas, los concejos o las juntas administradoras locales, sobre las siguientes materias:

1. Las que sean de iniciativa exclusiva del Gobierno, de los gobernadores o de los alcaldes, según lo establecido en los artículos 154, 300, 313, 315, 322 y 336 de la Constitución Política.

2. Presupuestales, fiscales o tributarias.

3. Relaciones internacionales.

4. Concesión de amnistías o indultos.

5. Preservación y restablecimiento del orden público.

In addition to listed issues,  the issues that are of exclusive initiative of the Government, the governors or the mayors, as established in articles 154 , 300 , 313 , 315 , 322 and 336 of the Political Constitution cannot be the subject of initiatives at the national level.
