Article 95
(1) Thereferendum is called by the President of the Slovak Republic if requested by apetition signed by a minimum of 350,000 citizens, or on the basis of aresolution of the National Council of the Slovak Republic, within 30 days after the receiptof the citizens' petition, or the resolution of the National Council of theSlovak Republic.
(2) […] If thePresident of the Slovak Republic files with the Constitutional Court of theSlovak Republic a petition for a decision whether the subject of the referendumwhich should be called on the basis of a citizens’ petition or a resolution ofthe National Council of the Slovak Republic is in compliance with theConstitution or a constitutional act, the period pursuant to paragraph 1 shallnot continue from filing of a petition by the President of the Slovak Republicuntil the decision of the Constitutional Court of the Slovak Republic becomeseffective.
Article 96
(2) A referendum shall be heldwithin 90 days from the day it was called by the President of the SlovakRepublic.
Article 97
(1) Areferendum may not be held within 90 days prior to elections to the NationalCouncil of the Slovak Republic.
(2) A referendum may be held on theday of elections to the National Council of the Slovak Republic.

Article 41f
(1) A motion to startproceedings on the conformity of the subject of a referendum, which shall beannounced under special regulation, may be submitted to the ConstitutionalCourt by the President of the Slovak Republic prior to declaring a referendum,if he/she has doubts on whether the subject of the referendum is in conformitywith the Constitution or a constitutional law.
Article 41g
(1) The Constitutional Courtshall decide on the motion within 60 days of its delivery.
“According to the constitution, the president is obliged to call a referendum within 30 days of receiving the referendum initiative. Furthermore, the president is obliged to set the date for the referendum within 90 days of the official call, with the exception that a referendum may not be held within 90 days before parliamentary elections.” (p. 158)
