117.Presentation of election petition

The following provisions shall apply with respect to thepresentation of an election petition-

(a)      thepetition shall be signed by the petitioner, or all the petitioners, if morethan one;

(b) the petition shall bepresented within 30 days after the day on which the result of the election hasbeen declared by the returning officer:

Provided that, when the return or election is questioned upon anallegation of an illegalpractice, the petition may be presented-

(i)          at any time before the expiry of 21 days after the dayon which the returning officer receivesthe return of election expenses of the person whose election is to bequestioned; or

(ii)       ifthe election petition specifically alleges a payment or money or some other actto have been made or done since that day bythe Member or with the privity of the Member or his election agent inpursuance or in furtherance of the illegal practice alleged in the petition, at any time within 30 days after the date ofsuch payment or other act;
