Artículociento doce

1. El recurso contenciosoelectoral se interpone ante la Junta Electoral correspondiente dentro de lostres d?as siguientes al acto de proclamaci?n de electos y se formaliza en elmismo escrito en el que se consignan los hechos, los fundamentos de Derecho yla petici?n que se deduzca.

Article 112

1. The electoral administrativeappeal is lodged/filed before the respective Electoral Commission (NB JuntaElectoral article 8 Ley Orgánica 5/1985, de 19 de junio, del Régimen ElectoralGeneral.) within three days of the proclamation of the elected and is formalizedin writing, in which it should state the facts, the legal grounds and therequests to be deducted.

Nota: Artículo 106

1. Durante el escrutinio, la Junta no puede anular ning?n acta ni voto.Sus atribuciones se limitan a verificar sin discusi?n alguna el recuento y lasuma de los votos admitidos en las correspondientes Mesas seg?n las actas o lascopias de las actas de las Mesas, salvo los casos previstos en el apartado 4del art?culo anterior, pudiendo tan s?lo subsanar los meros errores materialeso de hecho y los aritm?ticos.

2. A medida que se vayan examinando las actas los representantes oapoderados de las candidaturas no pueden presentar reclamaci?n ni protestaalguna, excepto aquellas observaciones puntuales que se refieran a la exactitudde los datos le?dos.

N.B.Article 106

1. During the general counting (NB. Three days after Election Day and upuntil 6 days after Election Day), the Electoral Commission cannot cancel outany protocol or vote. Its responsibilities are only to verify, without anydiscussion, the counting and the addition of the votes admitted at theElectoral Boards according to the protocols or the protocols’ copies. TheElectoral Commission can only rectify mere errors of fact and arithmeticalerrors.

2. As the protocols are being examined the representatives of thecandidates cannot raise claims or objections, except in the case of specificobservations related to the accuracy of the read data read.
