355Requisites of petition

(e) be filed inthe Registry of the High Court within 40 days

after:

(i) if thepolling day for the election in dispute is not the

polling day forany other election—the return of the writ

for theelection; or

(ii) if thepolling day for the election in dispute is also the

polling day foranother election or other elections—the

return ofwhichever of the writs for the election in

dispute andthat other election or those other elections is

returned last;or

(iii) if thechoice or the appointment of a person to hold the

place of aSenator under section 15 of the Constitution

is indispute—the notification of that choice or appointment.
