المادة السادسة و الستون
1- تختص المحكمة الدستورية العليا في النظر في الطعون الخاصة بانتخابات أعضاء مجلس الشعب
2- تقدم الطعون من قبل المرشح خلال ثلاثة أيام تبدأ من تاريخ إعلان النتائج و تبت المحكمة بها بأحكام مبرمة خلال سبعة أيام من تاريخ انتهاء مدة تقديم الطعون

 

 

Article 66: the Constitutional court is responsible for reviewingcomplaints regarding parliamentary election results. Candidates can submittheir complaints within three days starting from the announcement of theelection results. The court, then, can issue its ruling within seven days afterthe end of complaint period.

Comment
Article66 and 89 are very brief in explaining the complaining process in challengesrelated to presidential and parliamentary election. However, we can assume thatthe constitutional court is obliged to issue reasoned decisions and not obligedto hold hearings in these complaints. This is based on the court practices in2012 election. In 2012, the constitutional court received 58 complaint relatedto parliamentary election results and there was no hearing for any of them.
