PART 5 ELECTIONPETITIONS

Trial of election petitions

67. (1) Every electionpetition shall betried in the same manner as any other action in the High Court by aJudge sitting alone.

(2) At theconclusion of the trial, the Judge shall determine whether—

(a) the memberof the Assembly whose return or election is complained of or any, and what,other person was duly returned and elected; or

(b) theelection was void; and shall certify such determination to the Governor, and,upon his certificate being given, it is final and the return shall be confirmedor altered, or a writ for a new election issued, as the case may require, inaccordance with the determination.
