Part I Preliminary
5. (1) For thepurpose of filling a casual vacancy in the membership of the House of Assembly,the date on which the vacancy shall be deemed to have occurred shall, subjectto section 45 of the Constitution,
(a) in the case of death, upon the date of death;
(b) in the case of an election being declared void onan election petition, upon the date-of the certificate of the Election Courtissued pursuant to the Election Offences and Controversies Act;
(c) in the caseof a person ceasing to be qualified to be a member of the House of Assembly orbecoming disqualified for any reason other than those mentioned in paragraphs(a) and (b), upon the date on which his office is declared to have beenvacated, either by the Speaker or by the Court.
