ELECTION PETITION

Section 116 In the case where the petitionis filed prior to the day of the
announcement of the results ofelection but the findings are concluded after that day or where
the petition is filed afterthat day and the findings reveal convincing evidence that the election
was not fair or legal and theElection Commission is of the opinion that there should be a new
election in a constituency orthe disfranchisement of any Member of the House of
Representatives should beordered, the provisions of Section 111 shall apply mutatis
mutandis.
In the case where the findingsreveal that an election in a polling station or
constituency was conducted inan unfair or illegal manner but the Election Commission is of
the opinion that there is noground to call for a new election as it will not affect the results of
the election already held, theElection Commission may order the dismissal.
The decision of the Election Commission underthis Section shall be final.
