71.          TheElection Tribunal may decide that the election of the Hluttaw representative isvoid, if it finds that an elected Hluttaw representative has been involved withany of the following:

 

(a)          thatit is apparent the elected Hluttaw representative obtained the majority votesby malpractices , or by inducement in the said manner, or the success orfailure of the election is due only to malpractices;

 

(b)          thatit is apparent malpractice has been committed in the interest of the electedHluttaw representative;

 

(c)        that it is apparent theelection is not free and fair;

 

(d)          thatit is apparent the election is not free and fair because of bribery andinterference in the exercise of electoral rights, or that the success in theelection is due to such acts;

 

(e)          thatit is apparent he is an individual or a member of any organisation contained inSub-sections (f), (g), (h) ,(i) or (l) of Section 10.

 

72.          (a)      The Election Tribunal shall, afterexamining the objections, submit to the Commission whether the elected personor the applicant who applied by submitting an electoral objection that he isentitled to be declared as the elected person is the elected person as Hluttawrepresentative.

 

(b)          Allthe members of the Election Tribunal shall sign the report in which theirdecision is included and submit to the Commission soonest.
