PART VIII-Election Petitions

89.Trial of election petitions

Every election petition shall be tried in the samemanner as an action in the Grand Court by a Judge sitting alone.

(2)At the conclusion of the trial the Judge shall determine whether the member ofthe Assembly whose return or election is complained of or any, and what, otherperson was duly returned and elected, or whether the election was void, and shall certify suchdetermination to the Governor, and, upon his certificate being given, suchdetermination shall be final; and the return shall be confirmed oraltered, or a writ for a new election issued, as the case may require, inaccordance with such determination.
