Jurisdiction in electoral matters (Wahlgerichtsbarkeit)
Art. 141. (1) The Constitutional Court pronounces upon
a)challenges to the election of the Federal President and elections to the general representativebodies, the European Parliament and the constituent authorities(representative bodies) of statutory professional associations;

b) challenges to electionsto a Land Government and to municipal authorities entrusted with executivepower;

c) application by a popularrepresentative body for a loss of seat by one of its members; application by atleast eleven members of the European Parliament from the Republic of Austriafor a loss of seat by a member from the Republic of Austria;

d) application by aconstituent authority (representative body) of a statutory professionalassociation for a loss of seat by one of the members of such an authority;

It is not clearlystated that the decisions of the Federal Electoral body are appealable beforethe Constitutional Court. Nevertheless, the Constitutional Court is the lastinstance in all election related issues.
