Article 135. (1) The Constitutional Court shall:

a)exercise, upon appeal, the constitutionality review over laws and decisions ofthe Parliament, Presidential decrees, decisions and ordinances of theGovernment, as well as the international treaties to which the Republic ofMoldova is a party;

b) givethe interpretation of the Constitution;

c)formulate its position on initiatives aimed at revising the Constitution;

d)confirm the results of republican referenda;

e) confirm the results of parliamentaryand presidential elections in the Republic of Moldova;

Article 89. (1) The Central Election Commission shall,within 48 hours of the election results tabulation, submit to theConstitutional Court the documents mentioned in Article 60 and the lists ofelected members of Parliament and candidates on reserve lists.

(2)Within 10 days of the date of receiving documents from the Central Election Commission,but not earlier than courts have finally ruled the complaints submitted accordingto legal procedures, theConstitutional Court shall either confirm or not, through a decision, thelegality of the elections. At the same time the Constitutional Courtshall validate the mandates of the elected members of Parliament.

 

Article 90. (1) The protocol on final results ofelections, along with the decision of the Constitutional Court on elections’ compliance tolegislation and validating at least two-thirds of the number of mandates,shall be submitted, within two days, to Parliament. A copy of these documentsand lists of candidates in reserve confirmed by the Constitutional Court shallbe submitted to the Central Election Commission.

 

Article92. Should the Constitutional Court establish thatduring the voting and counting procedures the provisions of this Code wereviolated that affected the voting results and mandates’ allocation, theelections shall bedeclared null.
