Requirement to hold a hearing in the last instance

“Five SEC decisions wereappealed to the Administrative Court, one by ND and four by UM. The Courtupheld the decision of the SEC in all five cases. The hearings were open to thepublic and did not involve the production of additional evidence in support ofany of the cases. All decisions were publicly communicated and published in duecourse on the website of the Administrative Court and the SEC.”

Even though the legislation does not provide for whether a hearing is required in election related complaints regarding parliamentary and presidential elections before the Administrative Court, the information for parliamentary elections is found in the OSCE/ODIHR report.
