HOUSE OF ASSEMBLY (ELECTIONS) ACT 14 of 1951, CHAPTER 2:01

 

Section 67:

“At thetrial of an election petition the Judge shall, subject to the provisions ofthis Act or of any Proclamation to be made by the President, have the samepowers, jurisdiction and authority, and witnesses shall be subpoenaed and swornin the same manner as nearly as circumstances will admit, as in a trial of acivil action in the High Court, and shall be subject to the same penalties forperjury.”

EasternCaribbean Supreme Court (Dominica) Act 10 of 1969, Chapter 4:02

 

Section 32:

“(1) On the hearing of an appealfrom any order of the High Court in any civil cause or matter, the Court ofAppeal shall have power to:

(a) confirm, vary amend or set aside the order or make such order as theHigh Court might have made, and to make such further or other order as thenature of the case may require;

(b) draw inferences of fact;

(c) direct the High Court to enquire into and certify its findings onany question which the Court of Appeal thinks fit to be determined before thefinal judgment in the appeal.”
