Artículo 9.3 La Constitución garantiza elprincipio de legalidad, la jerarqu?a normativa, la publicidad de las normas, lairretroactividad de las disposiciones sancionadoras no favorables orestrictivas de derechos individuales, la seguridad jur?dica, laresponsabilidad y la interdicci?n de la arbitrariedad de los poderes p?blicos.

 

Artículo 24.1 Todas las personastienen derecho a obtener la tutela efectiva de los jueces y tribunales en elejercicio de sus derechos e intereses leg?timos, sin que, en ning?n caso, puedaproducirse indefensi?n.

Artículo 120

1. Las actuaciones judiciales ser?np?blicas, con las excepciones que prevean las leyes de procedimiento.

2. El procedimientoser? predominantemente oral, sobre todo en materia criminal.

3. Las sentencias ser?nsiempre motivadas y se pronunciar?n en audiencia p?blica.

 

Section 9.3. TheConstitution guarantees the principle of legality, the hierarchy of legalprovisions, the publicity of legal statutes, the non-retroactivity of punitiveprovisions that are not favourable to or restrictive of individual rights, thecertainty that the rule of law shall prevail, the accountability of publicauthorities, and the prohibition of arbitrary action of public authorities.

Section 24. 1. Allpersons have the right to obtain effective protection from the judges and thecourts in the exercise of their rights and legitimate interests, and in no casemay there be a lack of defense.

Section 120

1. Judicialproceedings shall be public, with the exceptions contemplated in the laws onprocedure.

2. Proceedings shallbe predominantly oral, especially in criminal cases.

3. Judgments shallalways specify the grounds therefore, and they shall be delivered in a publichearing.

Articles53, 54 and 55.

Article 53

The Sala or, when appropiate, the Secci?n when addressingthe substance of the matter, shall pronounce, in its judgement, any of thesedecisions:

a)Granting/Conferment of Amparo (Otorgamiento de amparo.)

b)Denial/refusal of Amparo. (Denegaci?n de amparo.)

Article 54

When the Sala or, when appropriate, the Secci?nwill hear the Writ of Amparo in the case of Judges’ or Courts’ decisions, itshall be limited to concretize whether rights and freedoms of the complainanthave been violated and  to preserve andrestore those rights and freedoms, as well as it shall refrain from any otherconsideration about the jurisdictional bodies’ actions.

Article 55

1. The judgement granting Amparo will includeone or more of the following pronouncements:

a) Declarationof nullity of the decisi?n, act or judgement/ruling which had restrained thefull exercise of the protected rights or freedoms, with the determination, whenappropriate, of the extension of its effects.

b) Recognitionof the right or public freedom /civil liberty, according with itsconstitutionally stated content.

c) Restorationof the appellant in the integrity of his/her right or freedom/liberty via theadoption of the appropriate measures, when possible, for its conservation.
