105. (1) The High Court shall hearand determine any question whether—(a) a person has been validly electedas a member of Parliament; or(b) the seat of a member has become vacant.(2)A question under clause (1) shall be heard and determined within six months ofthe date of lodging the petition.

Date of Commencement:2nd December, 2011 85A. An appeal from the High Court in an election petition concerning membership of the NationalAssembly, Senate or the office of county governor shall lie to the Court ofAppeal on matters of law only and shall be—
filed within thirtydays of the decisions of the High Court;and (b) heard and determined within six months of the filing of theappeal.
