85. Petitions against elections
A petition complaining of the undue electionor undue return of a member of the Assembly (in this Law called an electionpetition) may be presented to the Grand Court by anyone or more of the followingpersons, that is to say- (a) a person who voted or had a right to vote at theelection to which the petition relates;
(b)a person claiming to have had a right to be returned at such election; or
(c)a person alleging himself to have been a candidate at such election.
89.Trial of election petitions
(1) Everyelection petition shall be tried in the same manner as an action in the GrandCourt by a Judge sitting alone.
(2)At the conclusion of the trial the Judge shall determine whether the member ofthe Assembly whose return or election is complained of or any, and what, otherperson was duly returned and elected, or whether the election was void, andshall certify such determination to the Governor, and, upon his certificatebeing given, such determination shall be final; and the return shall beconfirmed or altered, or a writ for a new election issued, as the case mayrequire, in accordance with such determination.
