Fifth Amendment tothe Interim Constitution of Nepal, 2006 (BS 2063)

3. Amendment toArticle 36B of the Constitution: Article 36B has been replaced by the followingArticle 36B:

36B. Election ofthe President:

(1) TheConstituent Assembly shall elect a President on the basis of politicalconsensus.

(2) Pursuant toSub-article (1), if consensus cannot be reached, whoever receives

the support of amajority of all current members of the Constituent Assembly shall be consideredto have been elected President.

(3) Otherprocedures regarding the election of the President shall be in accordance withthe decisions of the Constituent Assembly.

(4) If anyindividual is elected President while holding a political position that hasbeen achieved through election, nomi nation or appointment, s/he shallautomatically vacate this position.”
