111. (1) Within a further prescribed time, notexceeding ten days after service of the notice of the presentation of thepetition, the respondent may object in writing to any recognisance on the groundthat any surety is insufficient or is dead or cannot be found or ascertainedfor want of a sufficient description in the recognisance, or that a personnamed in the recognisance has not duly acknowledged the recognisance.

(2) If the objection is allowed, the petitioner may,within a further prescribed time not exceeding five days, remove it by adeposit in the prescribed manner of such sum of money as will in accordance withsubsection (3) or subsection (4) make the security sufficient.

(3) Any objection to a recognisance may be heard and determinedby the Registrar, and the Registrar may, if he allows the objection, directwhat sum should be deposited so as to make the security sufficient.

(4) A determination or direction by the Registrarunder subsection (3) may be reviewed by the High Court and upon such review theCourt may make any determination or give any direction which the Registrar mayhave made or given.

(5) If no security isgiven as required by section 109 or any objection is allowed and not removed asmentioned above, no further proceeding shall be had on the petition.

109. (1) At the time of presenting a representationpetition or within three days afterwards the petitioner shall give security forall costs which may become payable by him to any witness summoned on his behalfor to any respondent.

(2) The security shall be?

DETERMINATION OF QUESTIONS AS TO ELECTION

2. The Court of Appeal shall have exclusivejurisdiction to hear and determine any question as to the validity of anelection of a President in so far as that question depends upon thequalification of any person for election or the interpretation of this Chapter,and the decision of that Court under this subsection shall be final.

3. Parliament may make provisions with respect to the personsby whom, the manner in which and the conditions upon which the proceedingsunder subsection (2) may be instituted in the Court of Appeal and subject toany provisions so made, provisions may be made with respect to these matters byrules of court. Until such provisions or rules are made the procedure formoving the Court of Appeal shall be by way of a representation petition.

 

Comment:According to theConstitution, the procedure for complaints regarding the validity ofpresidential election is the same as the procedure for complaints regardingparliamentary election unless other provisions are made (and none could befound).
