(1) The rules ofprocedure to be adopted for election petitions and appeals arising therefromshall be as set out in the First Schedule to this Act.

(2) The Presidentof the Court of Appeal may issue practice directions to election tribunals.

 

FIRST SCHEDULE

 

Rules of Procedurefor Election Petitions

 

Furtherparticulars.

Evidence need notto be stated in the election petition, but the Tribunal or Court may order suchfurther particulars as may be necessary -

(a) to preventsurprise and unnecessary expense;

(b) to ensure fair and properhearing in the same way as in a civil action in the Federal High Court; and

(c) on such termsas to costs or otherwise as may be ordered by the Tribunal or Court.

 

Hearing ofpetition to be in open Tribunal or Court

Every electionpetition shall be heard and determined in an open tribunal or court.
