(1)  The State Election Commission, “ex officio” or based on afiled complaint, shall with a decision annul the voting at the polling stationin the following cases:

  if the Election Board fails to conduct the voting in the mannerdefined by this Code;

  if the secrecy of voting has been violated;

  if the voting has been suspended for more than three hours;

  if the police has failed to respond to the request forintervention made by 
the Election Board, provided there was a need for suchintervention and 
that this has influenced the conduct of the voting in thepolling station;

  in case it has been established that there is a greater numberof ballots in 
the ballot box than the number of voter turn out; and

  if any person or persons have voted for other person (persons).

(2)  When decidingupon complaints the State Election Commission is obliged to inspect the overallelection materials in the cases stipulated in the lines 1, 2, 5 and 6 ofparagraph 1 of this article, if the facts which are invoked have been enteredin the protocols.

(3) TheState Election Commission shall repeat the voting with a decision in cases
stipulated in paragraph 1 of this article at the polling stations where thevoting has been annulled, if the total number of voters registered at thosepolling stations on the level of electoral district, city, i.e. municipalityhas an impact on the overall results.
