المادة التاسعة والثمانون

1- تختصالمحكمة الدستورية العليا في النظر في الطعون الخاصة بانتخاب رئيس الجمهورية.

2- تقدم الطعون من قبل المرشح خلال ثلاثة أيام تبدأ من تاريخ إعلان النتائج، وتبت المحكمة بها بأحكام مبرمة خلال سبعة أيام من تاريخ انتهاء مدة تقديم الطعون.

 

Article 89: theConstitutional court is responsible for reviewing complaints regardingpresidential election results. Candidates can submit their complaints withinthree days starting from the announcement of the election results. The court,then, can issue its ruling within seven days after the end of complaintperiod.

Article66 and 89 are very brief in explaining the complaining process in challengesrelated to presidential and parliamentary election. However, we can assume thatthe constitutional court is obliged to issue reasoned decisions and not obligedto hold hearings in these complaints. This is based on the court practices in2012 election. In 2012, the constitutional court received 58 complaint relatedto parliamentary election results and there was no hearing for any of them.
