Constitution 1996, Articles 41(2)

(2) Any question whichmay arise as to whether --

(a) any provisions ofthis Constitution or any law relating to the election of a President has been compliedwith;

(b) any person has beenvalidly elected as President under Article 34; shall be referred to anddetermined by the full bench of the Supreme Court.

Post-election challenges to results canbe submitted to a full bench of the Supreme Court in the case of thepresidential election within 14 days of the swearing-in of the declared winner.

There is no time limit for dealing withthose cases and some in the past have taken years to reach judgment after thedeclared winner has been sworn in.

Constitution 1996, Articles 72 - An appeal from the determination of the High Court under this Articleshall lie to the Supreme Court:

Provided that an appeal shall lie to the SupremeCourt from any determination of the High Court on any question of law includingthe interpretation of this Constitution.

Comment
The judicial system comprises a Supreme Court (finalcourt of appeal), a High Court, an Industrial Relations Court and subordinatecourts and local courts. Law provides that appeals against legislative electiongo to High Court while appeals against presidential election go to the Supreme Court.
