Determinationof Supreme Court
98. At the conclusion ofthe trial of an election petition the Supreme Court shall determine whether theperson whose return or election is complained of, or any other and what person,was duly returned or elected, or whether the election was void, and shallcertify such determination in writing. Such certificate shall be dealt with ashereinafter provided.
97.(2).Every election petition shall be tried as expeditiously as possible and everyendeavour shall be made to conclude the trial of such petition within a periodof six months after the date of the presentation of such petition. The SupremeCourt shall make order deciding such petition without undue delay after thedate of the conclusion of the trial of such petition.
102. (1). Every electionpetition shall be presented within twenty one
days of the date ofpublication of the result of the election in
the Gazette:
Provided that an electionpetition questioning the return of the election upon the ground of a corruptpractice and specifically alleging a payment of money or other act to have beenmade or done since the date aforesaid by the person whose election isquestioned or by an agent of such person or with the privity of such or hisauthorized agent in pursuance or in furtherance of such corrupt practice may,so far as respects such corrupt practice, be presented at any time withintwenty eight days after the date of such payment or act.
(2). An election petitionpresented in due time may, for the purpose of questioning the return or theelection upon an allegation of a corrupt or illegal practice, be amended withthe leave of a Judge of the Supreme Court within the time within which anelection petition questioning the return or the election upon that ground maybe presented.
