Electoral Act 2006

110. (1) Whenever the Commission,the Director of Elections,

an election officer or anyperson is required under this Act to decide

an objection, dispute,complaint or an appeal, the Commission or

that person may attempt toresolve the issue, that is the subject of

the objection, dispute,complaint or appeal, through conciliation or

mediation.

(2) The Commission shallprescribe the manner for handling any

objection, dispute, complaintor appeal under this Act.

 

111. (1) The Commission shall,for purposes of resolving electoral disputes, constitute such number ofconflict management committees as the Commission may determine.

Post-election challenges to results canbe submitted to a full bench of the Supreme Court in the case of thepresidential election within 14 days of the swearing-in of the declared winner.

There is no time limit for dealing withthose cases and some in the past have taken years to reach judgment after thedeclared winner has been sworn in.

Constitution 1996, Articles 41(2)

(2) Any question whichmay arise as to whether --

(a) any provisions ofthis Constitution or any law relating to the election of a President has beencomplied with;

(b) any person has been validly elected asPresident under Article 34; shall be referred to and determined by the fullbench of the Supreme Court.
