Section 15:

“(5) The decision of the returning officer that a nomination paper isvalid or invalid shall not be questioned in any proceeding whatsoever, otherthan by an election petition.”

Representation ofthe People Act (CAP. 379) and its subsequent amendments

 

Section 44:

(3) “The petitionshall be in such form as may be prescribed by the Rules of the Supreme Courtand shall state the prescribed matter and be signed by the petitioner or allthe petitioners if more than one, and shallbe presented to the High Court.”

 

Art. 46:

“(1) An election petitionshall be tried by the High Court andthe judge presiding at the trial of an election petition is hereinafterreferred to as the election court.”
