D.P.R.  (Decreto Presidente dellaRepubblica) n. 361- 30 March 1957

 

Art22: Delegates from each list can appraise, within the same day, the objectionsremarked ​​by the District Election Commission and all the amendments done tothe concerned list.

The District Central Commission shall meet again the next day to hearfrom the Delegates of the disputed or amended lists to eventually admit newdocuments and/or formal corrections and decide on the dispute.

 

Art22:Idelegati di ciascuna lista possono prendere cognizione, entro la stessagiornata, delle contestazioni fatte dall'ufficio centrale circoscrizionale edelle modificazioni da questo apportate alla lista.

L'ufficio centrale circoscrizionale si riunisce nuovamente il giornosuccessivo alle ore 12 per udire eventualmente i delegati delle listecontestate o modificate ed ammettere nuovi documenti nonch? correzioni formalie deliberare in merito.

This form of complaint has been considered bythe Italian jurisprudence a first instance for challenges arising out ofregistration of political parties (or their lists or candidates). The complaintin front of the National Central Commission described later is instead the lastinstance.  According to the jurisprudenceof the Supreme Court (Corte di Cassazione,April 6, 2006 n. 8118, id. April 8, 2008 n. 9151) there is complete lack ofjurisdiction of the ordinary and administrative courts to judge disputesconcerning the electoral operations and disputes relating to national politicalelections.
