88. (1) There is established the IndependentElectoral and Boundaries Commission.(4) The Commission is responsible for conductingor supervising referenda and elections to any elective body or officeestablished by this Constitution, and any other elections as prescribed by anAct of Parliament and, in particular, for—

(e)the settlement of electoral disputes, including disputes relating to or arisingfrom nominations but excluding election petitions and disputes subsequent tothe declaration of election results;

TheOffice of the Registrar of Political Parties was established through anenactment of the political parties Act No. 10 of 2007. The Registrar isresponsible for registration of Political Parties and arbitration of disputes,maintaining records of political parties and administration of the PoliticalParties Fund. Registrar of Political Parties is an office created by thePolitical Parties Act of 2007 [Part II Sections 3 and 4] as an office under theelections management body in Kenya and currently that is the IndependentElectoral and Boundaries Commission.
