Chapter 12 :: Elections of deputies to the Mazhilis of the Parliament

Article 89. Registration of candidates to theMazhilis
1. Party lists submittedby political parties and candidates nominated by the Board of the Assembly ofthe People of Kazakhstan is registered by the Central Election Commission.

7. Refusal to register orcancellation of the decision to register the party list may be appealed to theCentral Election Commission and/or court within seven days. The CentralElection Commission or the court shall issue its decision on the complaintwithin seven days of the date of submission of the complaint. 
Refusal to register or cancellation of the decision to register the candidatenominated by the Board of the Assembly of the People of Kazakhstan may beappealed to the Central Election Commission and/or court within two days. TheCentral Election Commission or the court shall issue its decision on thecomplaint within one day.

Article20. Arrangement of operations of election commissions and appealing againstactions thereof. Publicity in activities of Election Commissions.

6. Election commissions shall take efforts to provide free access to decisionsmade by commissions for all, through publication and distribution of suchdecisions in public telecommunication networks. In cases stipulated hereby,such decisions shall be made public in other ways. 
Political parties not represented in election commissions may delegate theirrepresentatives to corresponding election commissions. During preparations forand conduct of an election, such representatives shall have a consultativevote. 
A representative of apolitical party having a consultative vote may speak at meetings of an electioncommission, make proposals with respect to issues within the terms of referenceof a respective election commission, appeal to a higher election commission ora court against actions/omissions of such election commission.

9.Decisions and actions (omissions) of an election commission can be appealed toa higher election commission and/or a court within ten days following such adecision or action (omission), unless different deadlines for appeals arestipulated herein. Appeals against decisions and actions/omissions of anelection commission filed after these deadlines shall not be givenconsideration. 
When appeals are considered both by the election commission and the court atthe same time, the election commission shall suspend proceedings until a courtjudgment becomes effective. The court shall notify the election commission ofthe appeal filed and effectiveness of its judgment based on the results ofproceedings.
