67. Generalpenalty.

Any person whois guilty of an offence under this Act or any rules or regulations madehereunder for which no penalty has been prescribed shall on summary convictionbe liable to a fine not exceeding five hundred dollars or to imprisonment for aperiod not exceeding six months, or to both such fine and period ofimprisonment.

29.- Employersto allow employee the prescribed period for voting.

(1) Everyemployer shall, on polling day, allow to every voter in his employ a reasonabletime during the prescribed period for voting, and no employer shall make anydeduction from the pay or other remuneration of any such voter or impose uponor exact from him any penalty by reason of his absence during such period.

(2) Any employer who,directly or indirectly refuses to grant, or by intimidation, undue influence orin any other way, interferes with the granting of reasonable time to any voterin his employ during the prescribed period of voting as in this sectionprovided, shall on summary conviction be liable to a fine not exceeding two thousand dollars or toimprisonment for a period not exceeding one year.

32.- Bribery.

(1) The followingpersons shall be deemed guilty of bribery within the meaning of this Act-

(a) every person who, directly or indirectly by himself or by any otherperson on his behalf, gives, lends or agrees to give or lend, or offers,promises, or promises to procure or to endeavour to procure, any money orvaluable consideration to or for any voter, or to or for any person on behalfof any voter, or to or for any other person, in order to induce any voter tovote or refrain from voting, or corruptly does any such act as aforesaid onaccount of that voter having voted or refrained from voting at any election;

(b) every person who directly or indirectly, by himself or by any otherperson on his behalf, gives or procures, or agrees to give or procure or toendeavour to procure, any office, place, or employment to or for any voter, orto or for any person on behalf of that voter, or to or for any other person, inorder to induce that voter to vote or refrain from voting, or corruptly doesany such act as aforesaid on account of any voter having voted or refrainedfrom voting at any election;

(c) every person who directly or indirectly, by himself or by any otherperson on his behalf, makes any such gift, loan, offer, promise, procurement oragreement as aforesaid to or for any person in order to induce that person toprocure, or to endeavour to procure, the return of any person as an electedmember of the House of Representatives or the vote of any voter at anyelection;

(d) every person who, upon or in consequence of any gift, loan, offer,promise, procurement or agreement, procures, or engages, promises or endeavoursto persuade the return of any person as an elected member of the House ofRepresentatives or the vote of any voter at any election;

(e) every person who advances or pays, or causes to be paid, any money to orfor the use of any other person , with the intent that that money, or any partthereof, shall be expended in bribery at any election, or who knowingly pays,or causes to be paid any money to any person, in discharge or repayment of anymoney wholly or in part expended in bribery at any election;

(f) every voter who, before or during any election, directly or indirectly,by himself or by any other person on his behalf, receives, agrees, or contractsfor, any money, gift, loan or valuable consideration, office, place oremployment, for himself or for any other person, for voting or agreeing tovote, or for refraining or agreeing to refrain from voting at any election;

(g) every person who, after any election, directly or indirectly, by himselfor any other person on his behalf, receives any money or valuable considerationon account of any person having voted or refrained from voting or havinginduced any other person to vote or refrain from voting at any election.

(2) No personshall be guilty of bribery under subsection (1) who gives to any other personany article not exceeding twenty dollars in value.

 

41.Disqualification for bribery, etc.

 Every person who is convicted of bribery,treating, undue influence, or personation, or of aiding, counselling orprocuring the commission of the offence of personation shall (in addition toany other punishment) be incapable during a period of seven years from the dateof conviction-

(a) of being registered as a voter, or voting at any election of a member ofthe House of Representatives;

(b) of being a member of the National Assembly or, if elected or appointedbefore his conviction, of retaining his seat as such member:

Provided thatin the event of any appeal the incapacity shall continue until the appeal isdetermined and thereafter, unless the conviction is quashed, remain in forcefor a period of seven years from the date of conviction.

 

36.- Penalty for bribery, etc.

(1) Every person who is guilty of bribery, treatingor undue influence shall be guilty of a corrupt practice, and is liable onsummary conviction thereof, to imprisonment for any term not exceeding oneyear, or to a fine not exceeding five hundred dollars or to both such fine andperiod of imprisonment.

(2) Every person who is guilty of personation or ofaiding, abetting, counselling or procuring the commission of the offence ofpersonation, shall be guilty of a corrupt practice, and is liable, on summaryconviction thereof, to imprisonment for any term not exceeding two years.

33. Treating.

The followingpersons shall be deemed guilty of treating within the meaning of this Act-

(a) every person who corruptly, by himself or by any other person, eitherbefore, during, or after any election, directly or indirectly gives orprovides, pays, wholly or in part, the expenses of giving or providing any food,drink, entertainment, or provision to or for any person for the purpose ofcorruptly influencing that person, or any other person, to vote or refrain fromvoting at that election, or on account of that person or any other personhaving voted or refrained from voting at the election;

(b) every voter whocorruptly accepts or takes the food, drink, entertainment or provisionaforesaid.

 

37. Penalty forcertain illegal practices at election.

Every personwho-

(a) votes or induces, or procures any person to vote, at any election,knowing that he or that person is prohibited by this Act, or by any law inforce, from voting at that election; or b) before or during any election,knowingly publishes any false statement of the withdrawal of a candidate at theelection for the purpose of promoting or procuring the election of anothercandidate; or
